Terms & Conditions

These Terms & Conditions (the “Terms”) govern your use of www.fionaemley.com (the “Site”) and your purchase or use of services, programs, classes, digital materials, and other offerings provided by Fiona Emley LLC (“Fiona Emley LLC,” “Fiona,” “we,” “us,” or “our”). By using the Site or completing a purchase, you agree to these Terms, our Privacy Policy, and any offer-specific agreement or checkout terms presented to you.

If you do not agree, please do not use the Site or purchase an offering.

1. Eligibility

The Site and Fiona’s paid services are intended for adults age 18 and older. By using the Site or purchasing an offering, you confirm that you are at least 18 and legally able to enter into an agreement.

2. Nature and Scope of Services

Fiona Emley LLC provides educational and wellness-focused somatic coaching, private sessions, programs, classes, group experiences, and related materials. Depending on the offering and what is collaboratively selected, Fiona’s work may be informed by EFT tapping, somatic breathwork, meditation, journaling, mantra, movement, sound, Kundalini-informed practices, reflective inquiry, intuitive guidance, and recovery-informed principles.

Fiona is not acting as a physician, psychotherapist, psychologist, counselor, dietitian, or other licensed healthcare provider. The Site and all offerings are educational and supportive. They are not medical care, psychotherapy, diagnosis, crisis care, detoxification, rehabilitation, or licensed treatment for substance use or addiction. They do not replace care from an appropriately qualified professional.

Fiona does not advise anyone to begin, discontinue, reduce, increase, or otherwise change medication or medical, psychiatric, psychological, or substance-use treatment. Please direct those questions to the appropriately licensed treating or prescribing professional.

3. Participation, Choice, and Safety

Somatic practices can create physical sensations and emotional responses and may not be appropriate for every person or circumstance. You remain responsible for deciding whether and how to participate. You are welcome to ask questions, request a modification, adjust the pace or intensity, keep your eyes open, take a break, or stop a practice at any time.

Before participating, please tell Fiona about any health condition, pregnancy, recent surgery or injury, medication, or other circumstance that could affect participation. Fiona may modify or decline to facilitate a practice and may ask you to consult an appropriately qualified healthcare professional first.

4. No Emergency or Crisis Services

Fiona Emley LLC does not provide emergency, crisis, medical, or mental-health response services. Emails, texts, forms, and other messages are not monitored continuously and must not be used for urgent support.

If you believe you or another person may be in immediate danger, contact 911 or the emergency service where you are located. In the United States, you may also call or text 988 for crisis support. People outside the United States should contact the appropriate emergency or crisis service in their location.

5. Offer Descriptions and Client Agreements

Each offer page and checkout should identify the service name, purpose, format, duration, number of sessions or included resources when applicable, current price, and material eligibility requirements or limitations.

Some offerings require acceptance of a separate client agreement, informed-consent acknowledgment, or checkout policy. Those offer-specific terms are incorporated into your agreement with Fiona Emley LLC. If a specific client agreement conflicts with these general Terms, the specific client agreement controls for that offering.

Offerings may be updated or discontinued. The description, price, and payment schedule shown and accepted at the time of purchase apply to that purchase, unless Fiona and the client later agree to a change in writing.

6. Payments and Recurring Payment Plans

Payments are processed through Wix Payments or another payment provider identified at checkout. Available payment methods may include major payment cards and eligible third-party payment options. Approval and repayment terms for any third-party financing or buy-now-pay-later option are determined by that provider, not Fiona Emley LLC.

If you choose an installment or recurring-payment plan, you authorize the payment method supplied at checkout to be charged according to the displayed schedule. A multi-payment option for a fixed-term program is a payment plan for that complete program; it is not a cancel-anytime membership unless the checkout expressly says otherwise.

If a scheduled payment fails, access to sessions, materials, or between-session support may be paused while the account is overdue. Any amount already earned or otherwise due under the applicable client agreement remains payable.

7. Refunds and Early Endings

Completed private sessions, classes already attended, digital materials already delivered, and program periods that have already begun are generally nonrefundable, except where required by law or where an offer-specific agreement provides otherwise.

Return to Joy, Embodiment, and any other fixed-term coaching journey may have specific early-ending and refund calculations. Those calculations are stated in the client agreement accepted at checkout and control over this general section.

If Fiona cancels an offering and cannot provide a reasonable rescheduling or replacement option, any refund or credit will be handled according to the applicable client agreement and law.

8. Scheduling, Cancellations, and Missed Sessions

For private appointments, please provide at least 24 hours’ notice when canceling or rescheduling whenever reasonably possible. A late cancellation or missed session may count as a used session or may be nonrefundable, as stated during booking or in the applicable client agreement. Genuine emergencies and exceptional circumstances may be handled differently at Fiona’s discretion.

If Fiona cancels a private session, it will be rescheduled and will not count as used. Arriving late may shorten the available session time.

9. Results and Personal Responsibility

Somatic coaching is collaborative and individual. Experiences and outcomes vary. Fiona Emley LLC does not promise or guarantee any particular emotional, physical, relational, recovery, financial, health, or life result.

Testimonials and examples describe individual experiences and do not guarantee that another person will have the same experience. You remain responsible for your choices, actions, decisions, and participation.

10. Intellectual Property and Personal Use

The Site and Fiona’s original text, videos, audio, graphics, frameworks, templates, practices, and other materials are owned by Fiona Emley LLC or used with permission and are protected by applicable intellectual-property laws.

Unless an offering says otherwise, purchased or shared materials are licensed to you for your personal, noncommercial use. You may not publish, reproduce for others, sell, license, teach, train from, distribute, or use them to provide services without Fiona’s prior written permission.

11. Acceptable Use of the Site

You agree not to misuse the Site; interfere with its operation or security; attempt unauthorized access; submit unlawful, abusive, defamatory, infringing, or deceptive material; impersonate another person; or use Site content in a way that violates these Terms or applicable law.

12. Third-Party Services and Links

The Site and Fiona’s offerings may rely on third-party services such as Wix, Zoom, Voxer, email providers, payment processors, financing providers, and external websites. Their availability, privacy practices, payment decisions, and terms are controlled by those providers. Fiona Emley LLC does not guarantee uninterrupted access to third-party technology.

Links to outside resources are provided for convenience and do not necessarily constitute endorsement. Please review the terms and privacy practices of third-party services before using them.

13. Privacy

Our collection and handling of personal information are described in our Privacy Policy. Coaching communications are not represented as legally privileged communications or protected healthcare records.

Please do not send medical records, financial account information, passwords, identifying documents, or other highly sensitive information through ordinary email, text, or messaging platforms unless Fiona has specifically requested a reasonably secure method.

14. Availability, Accuracy, and Changes

We make reasonable efforts to keep the Site accurate and available, but we do not guarantee that every page will always be complete, current, uninterrupted, or error-free. We may correct errors and update the Site or these Terms when reasonably necessary.

The “Last updated” date will identify the current version. Changes apply prospectively. Material terms accepted for an existing paid program will not be changed retroactively without the client’s agreement, except where a change is required by law.

15. Limitation of Liability

To the fullest extent permitted by law, Fiona Emley LLC is not liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the Site or an offering. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or limited.

16. Resolving Concerns

If a concern arises, please contact Fiona first so there is an opportunity to understand and address it in good faith.

If a concern cannot be resolved directly, Fiona and the other party may participate in mediation if both agree in writing after the concern arises. These Terms do not require mandatory arbitration.

17. Governing Law and Venue

These Terms are intended to be governed by the laws of the State of Texas, without taking away any consumer right that cannot lawfully be waived in the user’s location. Any court proceeding that is permitted and not resolved by agreement is intended to take place in a court of competent jurisdiction in Texas.

18. Severability and Entire Agreement

If one provision of these Terms is found unenforceable, the remaining provisions are intended to continue to the fullest extent permitted by law.

These Terms, the Privacy Policy, the checkout disclosures, and any applicable offer-specific agreement contain the agreement governing your use of the Site and purchase of an offering. A written exception or change agreed to by Fiona and a client applies only to that arrangement.
